  5. [5]Speck v. 3M Co., No. 3:20-cv-05845-JD, Order re Summary Judgment, ECF No. 475 (N.D. Cal. Apr. 5, 2024) [court_record]
    Locator
Order pp. 5-7 (Bath Iron Works section; recitation of deposition evidence and asbestos acknowledgment)
    Finding type
    litigation_documented
    Finding
In a partial summary-judgment order in Speck v. 3M Co., the court recited evidence that John Speck worked for three or four months during a major overhaul of USS Agerholm, entered its engine room while other trades removed turbines, boilers, and insulation, and walked through insulation dust. The order states that Bath Iron Works acknowledged original insulation on its 1940s naval destroyers contained asbestos and held this evidence sufficient to create triable questions of actual exposure and substantial-factor causation as to Bath Iron Works. The order is a discovery-record and summary-judgment-stage ruling, not a trial finding or final judgment on those questions.

Agerholm overhaul in the 1960s; order filed 2024-04-05
    Population
John Speck, civilian electrician working at Mare Island Naval Shipyard; estate asbestos litigation
    Limitations
Discovery-stage evidence summarized in a partial summary-judgment ruling. The court did not make a trial finding that Speck was exposed or that exposure caused injury; it held the evidence was triable as to Bath Iron Works. The finding is specific to evidence concerning Speck and the builder, does not quantify asbestos aboard, does not inventory other materials or locations, and does not establish that ACM remains aboard or liability to other people.

    Finding
The published California appellate opinion in Garza v. Asbestos Corp., Ltd. records Joseph Garza's trial testimony that after service aboard USS Randall he served for about eighteen months aboard USS Agerholm (DD-826) as a boiler man second class, in charge of No. 2 boiler room. He described similar repair work with piping insulation and adhesive cement aboard both vessels, identified Eagle-Picher Super 66 as an insulating cement he used, and testified to dust from opening and mixing bags and cleaning insulation debris without respiratory protection. A jury returned an asbestos-injury judgment for the plaintiffs and the Court of Appeal affirmed the judgment in all respects. The verdict's fault allocation was not apportioned to Agerholm alone.

About 1955-1956 aboard Agerholm; judgment affirmed 2008
    Population
Joseph Garza, Navy boiler man; asbestos-related asbestosis and pleural disease litigation
    Limitations
This is trial testimony recited in a published appellate opinion and a jury judgment affirmed on appeal. Garza served on USS Randall as well as Agerholm and had other lifetime exposure sources; the jury's 75/25 fault allocation was not assigned to Agerholm alone. The opinion does not establish a ship-wide inventory, quantities aboard, current ACM, or exposure of other people.
