  3. [3]Board of Veterans' Appeals, Citation Nr. 1604561, Decision Date 02/08/16 (Docket No. 14-21 686) — appeal of February 2012 rating decision, Department of Veterans Affairs Regional Office, Reno, Nevada; Veterans Law Judge Steven D. Reiss [court_record]
    Finding type
    litigation_documented
    Finding
Ship-specific asbestos finding: the Board records that the veteran 'served as a boatswains mate on the U.S.S. Calvert, a Navy ship known to contain asbestos materials.' Finding of Fact 2 states: 'Affording the Veteran the benefit of the doubt, the Veteran was exposed to asbestos while serving on active duty.' The veteran's active service ran December 1960 to August 1964, overlapping Calvert's second commission (18 October 1950 – 18 May 1966). The veteran died in January 2011; the revised certificate of death listed carcinoma of the lung due in part to asbestos exposure; the Board granted service connection for cause of death. The Board also noted the veteran participated in Operation Helping Hand, which may have involved asbestos exposure from collapsed and damaged buildings.

    Limitations
Classified at the less-final stage per litigation discipline: this is an administrative benefit-of-the-doubt/equipoise determination, not a trial finding or affirmed judgment. The Board's exposure concession rested on equipoise, not definitive proof; the treating physician could not identify when or where exposure occurred; the veteran was also a smoker for ~26 years with civilian asbestos exposure as a building inspector/contractor. No specific asbestos products aboard Calvert are identified. Establishes a ship-specific asbestos association for this hull; does not quantify asbestos aboard or establish exposure for any other individual.

  4. [4]General historical context on WWII-era U.S. naval construction materials; no hull-specific source [other_primary]
    Finding type
    asbestos_application
    Finding
Era context only: as a 1942-built attack transport serving through 1966, the ship's engineering plant and hull would have carried era-standard insulation, lagging, gaskets, and packing materials typical of early-1940s naval construction.

    Limitations
Class/era inference only — never a ship-specific finding. The ship-specific evidence for this hull is the VA Board decision above; this row is background only.
