DANFS record for this hull: Gearing-class destroyer; specifications block gives displacement 2,425, length 390'6", beam 41'1", draft 18'6", speed 35 k., complement 367, armament 6 5", 5 21"tt., 6 dcp., 2 dct. Launched 22 April 1945 by Bath Iron Works, Bath, Maine; sponsored by Mrs. C. P. Cecil; commissioned 29 June 1945, Commander W. Outerson in command. Arrived San Diego home port 20 November 1945; operated as part of Joint Task Force One in the atomic bomb tests at Bikini and supported occupation forces in Japanese waters; returned 9 August 1946. Second Far East deployment 26 August 1947 - 5 May 1948 (China, Japan, Okinawa). Reclassified DDR-835 18 March 1949; left San Diego 4 April 1949 for Newport, R.I., and Atlantic Fleet assignment; from December 1950 homeported Norfolk, Va. Through 1960: midshipmen training cruises, Sixth Fleet Mediterranean deployments including a watchful patrol in the eastern Mediterranean during the Suez Crisis of fall 1956, and NATO operations from north of the Arctic Circle to the Mediterranean. From January 1959, fitted with complex electronic computational and tracking equipment for air-defense experiments. Named for Rear Admiral Charles Purcell Cecil (born Louisville, Ky., 4 September 1893; killed in an airplane crash in the Pacific 31 July 1944).

Bath Iron Works construction trades 1944-45; wartime and postwar crew (DANFS design complement 367)
    Limitations
DANFS documents identity, specifications, and service history, not materials or asbestos content. The published entry's narrative ends around 1960 - it does not cover the FRAM I modernization, Vietnam deployments, 1979 decommissioning, or Greek transfer (post-1960 chronology carried from NVR and secondary compilations). Mirror/Wayback text cited because the live NHHC page serves 404. Namesake's state, Kentucky, explains the CourtListener name-collision pattern (Cecil family estate litigation).

    Finding
Federal administrative adjudication naming this hull in a granted asbestos claim: VA Board of Veterans' Appeals Citation Nr. 1109502 (Docket 09-39 721; St. Petersburg RO; decided 10 March 2011; Veterans Law Judge S. S. Toth). Finding of Fact 2: 'the Veteran served aboard the USS Little Rock (CLG-4), the USS Koelsch (DE 1049), the USS Gearing (DD 710), the USS Charles P. Cecil (DD 835), and the USS Dyess (DD 880). All five ships were known to have contained asbestos or asbestos-related products.' The decision's narrative attributes the known-to-contain-asbestos recital to a cited third-party list (mesotheliomaweb.org/navyshipsasbestos.html). The Board conceded the veteran's in-service asbestos exposure ('the Board concedes asbestos exposure'); noted post-mortem lung-tissue findings of asbestos bodies, grade III asbestosis, bilateral pleural plaques, and bilateral pleural fibrosis; and granted the widow's claim: 'Entitlement to service connection for the cause of the Veteran's death is granted' (esophageal squamous cell carcinoma, death January 2008). Veteran served December 1960 - March 1983 aboard nine ships and at shore stations including Boston Naval Shipyard and Philadelphia Naval Shipyard.

    Population
Navy veteran, service December 1960 - March 1983 aboard nine ships incl. USS Charles P. Cecil (DD 835), plus shore/shipyard stations; widow appellant
    Limitations
Administrative merits adjudication - above a pleading, below an Article III trial finding; BVA decisions are non-precedential and apply the veteran-favorable reasonable-doubt standard (38 C.F.R. 3.102). The ship-specific asbestos-content recital ('known to have contained asbestos or asbestos-related products') cites a commercial list site (mesotheliomaweb.org), not a survey or materials record of this hull. Exposure was conceded for the veteran's service collectively across five asbestos-reported ships and shore/shipyard stations; nothing is apportioned to DD-835 specifically, no asbestos product aboard is identified, and the decision establishes nothing about other crew members.

Postwar crew, 1960-1979; FRAM yard workers (New York Naval Shipyard, 1963-64) per secondary attribution
    Limitations
Secondary compilations, not official records: NavSource/Tin Can Sailors dates corroborate the NVR (stricken 10/01/1979; SAP disposal 08/01/1980) but the FRAM yard attribution, Vietnam deployment dates, and Greek-service details are not independently verified against official records. TCS's 'March 18, 1948' DDR-classing line is a typo for the 1949 reclassification in DANFS/NVR (ex-DDR). The NavSource crew figure (336) conflicts with DANFS (367) - conflict carried in gaps.

Speck ECF 475 pp. 5-7 (Bath Iron Works section); shipyard dataset yard records
    Finding type
    asbestos_application
    Finding
Era/design/yard inference for this hull: a Gearing-class destroyer built 1944-45 at Bath Iron Works with the class-standard plant of four Babcock & Wilcox superheated boilers feeding 60,000-shp GE geared steam turbines - the peak Navy asbestos-use era - would have carried period-standard asbestos insulation, lagging, gaskets, packing, fireproofing, and deck coverings. Builder corroboration at yard level: a 2024 federal summary-judgment order (Speck v. 3M Co., N.D. Cal.) recites that Bath Iron Works acknowledged original insulation on its 1940s naval destroyers contained asbestos - an acknowledgment covering the yard's wartime destroyer output generally, of which this hull is one. Builder Bath Iron Works is documented at yard level in the Atlas shipyard dataset (bath-iron-works). The 1963-64 FRAM I yard period (New York Naval Shipyard per secondary accounts) is a documented insulation-disturbance-era event for the class.

    Limitations
Class/era and builder-yard inference only - not a ship-specific finding for DD-835. The Speck order's recited BIW acknowledgment covers the yard's 1940s destroyers as a group; it was recited in litigation about a different hull (Agerholm) and is not a finding that asbestos was aboard Charles P. Cecil. FRAM yard attribution rests on secondary sources. Presence of boilers/steam plant does not itself prove installed asbestos aboard this hull.

    Finding
Class-level litigation recital bearing on this hull's design family: the omnibus opinion in Goodrich v. Air & Liquid Systems Corp. (E.D. Va., MDL-adjacent asbestos litigation) recites that 'an engineering drawing for the insulation and lagging of forced draft blower turbines for the class of destroyers (DD 692, USS Allen M. Sumner class)... specifies the use of amosite felts and asbestos cloths,' and quotes an expert report giving a partial tally of approximately 30.3 tons of asbestos thermal insulation/lagging in the fire rooms and engine rooms of Sumner/Gearing-class destroyers. Charles P. Cecil (DD-835) is a Gearing-class lengthened derivative of the Sumner design sharing the class machinery arrangement.

    Limitations
Litigation-record recital of an expert report and a Navy engineering drawing at class level - not a ship-specific finding for DD-835; the drawing covers DD-692-group machinery shared by the Gearing class, and the ~30.3-ton figure is an expert partial tally for fire/engine rooms, not a hull inventory. Finding
CourtListener sweep (authenticated API v4 via fleet helper cl-auth-search.py): exact-phrase opinion query '"Charles P. Cecil"' returned 6 published opinions - all Kentucky Court of Appeals estate litigation involving Cecil family decedents (e.g., estate of Charles P. Cecil III; Granville Cecil estate, Boyle County, Ky., 1917-1952), classified name collision, none involving the ship or asbestos. Exact-phrase opinion query '"USS Charles P. Cecil"' returned 0 indexed opinions. Remaining planned queries - '"USS Charles P. Cecil"' docket type, '"DD-835"' opinion/docket, '"Charles P. Cecil"' docket, '"Charles P. Cecil" asbestos' - were not completed: repeated requests returned the helper's fleet-wide pacing stand-down notice within the session window. Separately, one qualifying federal asbestos adjudication naming this hull was located outside CourtListener: BVA Citation Nr. 1109502 (ev-03).

Negative finding across the reviewed corpus: no ship-specific asbestos-containing-material survey, abatement record, material inventory, construction specification, FRAM work package, hazmat disclosure, museum/owner asbestos disclosure, or disposal-phase record was located for DD-835 in any source reviewed (DANFS/NHHC, NVR, NARA Ship Plan Index, NavSource, Tin Can Sailors association history, VA BVA corpus). The only ship-specific asbestos record located is the BVA adjudication (ev-03), whose asbestos-content recital traces to a third-party list rather than a materials survey of this hull.

Absence of located records is not proof of absence: DD-835 is a WWII-era steam destroyer built and modernized in the peak asbestos period, and the BVA record recites it was 'known to have contained asbestos.' Plausible unsearched repositories include NARA RG 19 hull drawings (ev-04), FRAM I work packages at New York Naval Shipyard records, shipyard contracts at Bath, and Greek Navy / Turkish scrapping records for the 1993-2003 disposal.
