    Finding
Merits-level administrative finding: the Board granted service connection for COPD secondary to asbestos exposure to a veteran who served aboard USS Fort Marion (LSD-22) as a Boatswain's Mate Third Class, April 1948 - March 1951. Finding of fact: 'It is just as likely as not the veteran was exposed to asbestos during service.' The Board credited his testimony that asbestos seeped through holes in insulation on steam pipes above his bunk for ~1.5 years and that he wore asbestos gloves in BM duties; a June 2003 CT showed bilateral pleural plaques 'suggestive of asbestos exposure'; a November 2005 VA examiner addendum concluded his respiratory condition was likely at least partly attributable to in-service asbestos exposure and that smoking was not the primary cause. The Navy Medical Liaison office (NPRC) had assessed a BM's asbestos-exposure probability as 'minimal' while conceding a definitive statement could not be made.

    Population
One veteran (BM3, aboard 1948-1951); by extension berthing-area and BM personnel
    Limitations
Administrative benefits adjudication under the veteran-favorable 'as likely as not' / reasonable-doubt standard (38 C.F.R. 3.102) - it finds this claimant was probably exposed aboard this hull; it is not a vessel survey, does not establish quantities or other individuals' exposure, and binds no tort defendant. The decision does not itself assert asbestos was present ship-wide; the exposure route documented is steam-pipe insulation in berthing plus BM work gloves.

    Finding
Docketed asbestos personal-injury/wrongful-death action confined to service aboard USS Fort Marion. Gerald Brantley alleged mesothelioma from asbestos exposure aboard the ship; per undisputed facts recited at summary judgment, he served aboard approximately 1958-1960 as a boilerman tending boilers, pumps, and valves in two boiler rooms and performing work on globe, gate, ball, micrometer, and steam valves. Procedural posture: filed San Diego Superior Court 30 Jan 2012; removed under 28 U.S.C. 1442(a)(1) federal-officer removal 2 Mar 2012; motion to remand denied 3 May 2012; Brantley died 8 Feb 2013 and daughter Lisa Grande continued as successor-in-interest (wrongful-death FAC 30 Apr 2013); sole remaining defendant Crane Co.'s summary-judgment motion DENIED 18 Aug 2014 - the court found a triable issue on exposure to Crane asbestos-containing products and granted severance of punitive damages for trial. CourtListener docket shows the case terminated 20 May 2015; no trial verdict or judgment on the merits was located.

    Limitations
Discovery-stage record: denial of summary judgment finds only a triable factual dispute, not that exposure occurred. The exposure account rests on the decedent's deposition testimony; Crane's admission covers its era product composition, not installation aboard this hull. Final disposition after docket closure (settlement, dismissal, or verdict) is not in located records - PACER file not pulled.

    Finding type
    litigation_product_id
    Finding
Products identified aboard this hull in litigation: (a) Crane Co. steam valves with internal asbestos-containing bonnet gaskets and stem packing - decedent testified he disassembled valves embossed 'Crane' to access internal packing/gaskets, releasing dust he inhaled; Crane Co. admitted manufacturing/selling valves with asbestos internal components into the late 1980s and that many valves bore the 'Crane' name on the valve; the court found this raised a triable exposure issue. (b) Westinghouse propulsion turbines - the complaint and the remand order's recital establish Fort Marion 'was outfitted with Westinghouse propulsion turbines that were later insulated with asbestos-containing materials by other parties' (plaintiff expressly disclaimed claims for exposure caused by defendants acting at government direction).

    Limitations
Product identification in a contested case that survived SJ - the Crane-valve identification is deposition-level testimony plus manufacturer admissions, sufficient for a triable issue but never adjudicated at trial. For the turbines, the pleaded theory assigns the asbestos insulation to 'other parties,' not Westinghouse; presence of Westinghouse turbines aboard is corroborated by the NavSource ONI spec block.

    Finding
Pleading-stage allegation naming the hull: the complaint's Schedule I lists 'U.S. Navy - USS Fort Marion (LSD-22) 1945-1948' and 'USS Bayfield (APA-33)' among decedent Richard Phillips Sr.'s asbestos-exposure worksites (occupation listed: 'Seaman, Postal Delivery Driver'), in a wrongful-death mesothelioma action against 16 defendants; complaint alleges exposure occurred 'at the sites listed on the attached Schedule I.' Limitations
A complaint's worksite list is an allegation, not a finding - no testimony, product identification, or adjudication of exposure aboard this hull appears in the located record. The schedule mixes two Navy hulls with civilian worksites (Piedmont Airlines, bakery, USPS, home remodeling), diluting hull-specific attribution. Case outcome after the tag-along notice not located. Finding
Era inference: Fort Marion's 1945-46 construction joined a two-boiler steam plant (Babcock & Wilcox oil-fired D-type, 250 psi) and steam turbines - the configuration for which WWII-era Navy specifications called asbestos thermal insulation on boilers, steam drums, and steam piping, plus asbestos gaskets and packing at flanges and valves. Rushworth documents that asbestos was used in US Navy shipboard pipe and machinery thermal insulation of the era and that thermal insulation was the most likely source of shipboard exposures in later litigation. Typical applications for the type: boiler and steam-drum insulation; steam-line lagging; valve and flange gaskets; machinery packing; accommodation-space insulation; winch/windlass brake linings.

  15. [15]Naval Vessel Register, ship detail page 'FORT MARION (LSD 22) - DOCK LANDING SHIP' (ARCHIVED COPY - live nvr.navy.mil URL returns only the generic NVR shell to automated fetch; Wayback capture 2024-08-22 shows the populated record, 'Last Updated: 03/04/2002') [other_primary]
    Locator
Wayback 20240822102222 capture of NVR SHIPSDETAIL_LSD_22.HTML; VESSEL STATUS and MILESTONE DATES blocks
    Finding type
    vessel_history
    Finding
The official NVR record (populated archived copy) confirms: Commission Date 01/29/1946; Stricken Date 10/31/1974; Status 'Disposed of through the Security Assistance Program (SAP), transferred, cash sale, ex-US fleet hull foreign military sale case number assigned'; Date Status Changed 04/01/1977; Custodian: TAIWAN; Class LSD 22; UIC 03122. Builder, launch, decommission, and physical-characteristics fields are blank in the record.

    Limitations
Archived copy cited and labeled - the live NVR URL serves a JS shell without the detail table at fetch time. NVR's 'Date Status Changed 04/01/1977' differs from NavSource's sale date of 15 April 1977 (SAP transfer-processing vs formal handover; two-week discrepancy unresolved). Blank fields are not evidence of absence - NVR fills milestone fields inconsistently for pre-1987 disposals.

    Finding type
    vessel_history
    Finding
Official Navy museum blurb corroborates the timeline: Casa-Grande-class dock landing ship commissioned 29 January 1946 at Gulf Shipbuilding Corp., Chickasaw; off Korea August 1950, Inchon Invasion and Wonsan Landing; war-long Japan-Korea troop transport, British-commando special operations, Wonsan mine-squadron support; extensive 1953 overhaul; Vietnam service ('numerous Vietnamese Counteroffensives'); decommissioned 13 February 1970; sold to Republic of China April 1977; served as ROCS Chen Hai (LSD-192) until May 1999. A model of Fort Marion was displayed in the museum's Korean War section (Cold War Gallery, Bldg. 70) until 2022.

    Limitations
Archived copy cited and labeled - live page 404s. Museum exhibit text is summary-level and contains a 'Chicksaw' spelling slip; it corroborates but adds no dates beyond DANFS/NavSource/NVR. The display model is a museum artifact, not the hull; hull disposition is the 2001 reef sinking.
