[5]Board of Veterans' Appeals, Citation Nr. 1417365, Decision Date 04/17/2014, Docket No. 09-02 393 (VA Regional Office, Newark, NJ) - official VA decision text [court_record]

- Finding
- VA administrative adjudication, ship-specific: In Board of Veterans' Appeals Citation Nr. 1417365 (decided 2014-04-17, Docket No. 09-02 393, Newark NJ RO), the Board reviewed service records showing the Veteran (USN active duty February 1959-November 1962) 'was assigned to work in the engine rooms of several Navy ships during his service, to include the U.S.S. Northampton, the U.S.S. Macon, the U.S.S. Providence, the U.S.S. Newport News and the U.S.S. Great Sitkin.' Exposure to asbestos 'was conceded by the RO in the January 2008 and December 2009 rating decision,' and the Veteran's claim for 'asbestos-related pleural disease with fibrosis' was GRANTED service connection (December 2009 rating decision). The issue on appeal - service connection for COPD as due to asbestos or as secondary to the service-connected pleural disease - was DENIED: every medical opinion of record attributed the COPD to a 40+ year smoking history, and the Board found no medical nexus between COPD and asbestos exposure/pleural plaques.

- Population
- Navy engineman (USN 1959-1962) assigned to engine-room duty aboard five named ships including Great Sitkin; ship's company complement 267 (DANFS)
- Limitations
- Stage discipline: this is a VA benefits adjudication, not tort litigation - the exposure 'concession' was made by the Regional Office for compensation purposes and accepted by the Board ('the Board accepts the Veteran's claim that he was exposed to asbestos during service'), covering his service across FIVE named ships with no per-ship apportionment. The record does not adjudicate that asbestos existed aboard Great Sitkin specifically - it concedes in-service exposure during an assignment set that included her. The product description ('steam pipes which were coated with asbestos in the engine rooms'; 'asbestos wrapping around the steam pipes in all the engine rooms and boiler rooms'; 'asbestos dust filled the air aboard the ships') is claimant testimony describing general conditions aboard the ships he served, not a surveyed finding about this hull. The asbestos-related disease claim was granted at RO level (pleural disease with fibrosis); the COPD claim denied here was decided on medical causation (smoking), not on exposure. Does not establish exposure for any other crew member, the ship's asbestos inventory, or any tort liability.

[6]Board of Veterans' Appeals, Citation Nr. 1504671, Decision Date 01/30/2015, Docket No. 10-44 973 (VA Regional Office, Newark, NJ) - official VA decision text [court_record]

- Finding type
- litigation_documented
- Finding
- Second VA docket naming the hull, claim-stage only: In BVA Citation Nr. 1504671 (decided 2015-01-30, Docket No. 10-44 973, Newark NJ RO), the record recites that 'the issue of service connection for chronic obstructive pulmonary disease (COPD) as due to asbestos and lead paint exposure has been raised by the record in a July 2014 statement, but has not been adjudicated by the Agency of Original Jurisdiction (AOJ)' - the Board lacked jurisdiction and referred it to the AOJ under 38 C.F.R. 19.9(b). The same decision records the Veteran's contention that while serving aboard USS Great Sitkin AE-17 the ship encountered rough seas and ammunition stored on the main deck - including 1000- and 500-pound bombs - broke loose, that he feared for his life trying to stop the bombs, and that the incident involved 'resulting fires, injuries to other sailors, and near explosions'; the PTSD claim grounded on that stressor was REMANDED (with the hernia-rating issue) for a new VA examination per the Court's July 2014 memorandum decision.

- service period not stated; 2010-2015 (claim through remand)
- Population
- Navy veteran claimant aboard Great Sitkin during a claimed heavy-weather ammunition-adrift incident (period not stated in the decision)
- Limitations
- Stage discipline: the asbestos-related COPD issue in this docket is a RAISED BUT UNADJUDICATED claim - less final than the conceding rating decisions behind ev-01 and not evidence that any adjudicator accepted exposure aboard this hull in this docket. The ammunition-adrift incident is claimant testimony ('the Veteran contends'; 'the Veteran described'), not a verified casualty report; no date is given for it in the decision and no official casualty record was located. Whether this claimant is the same veteran as ev-01 cannot be verified - both dockets share the Newark RO and an engine-room/asbestos claim theme but BVA decisions are anonymized; treated as separate dockets. Remand means no final Board disposition on PTSD/hernia issues. Does not establish the ship's asbestos inventory or any other person's exposure.

- Official service record (DANFS): namesake is the Great Sitkin volcano in the Aleutian Islands. Launched under Maritime Commission contract by North Carolina Shipbuilding Co., Wilmington, N.C., 20 January 1945 (sponsor Miss Anne L. Dimon[sic]); commissioned at Charleston, S.C., 11 August 1945, Lt. Comdr. William F. Smith in command. After Norfolk shakedown she sailed to New York '2 November' (1945) to begin dumping condemned ammunition in an assigned area off Sandy Hook, N.J., continuing that duty nearly a year and returning to Norfolk November 1946. Late-1940s pattern: Caribbean and Canal Zone ammunition-replenishment trips, twice to Gibraltar, plus local operations. From 1951 she served as a mobile ready-reserve ammunition source, deploying regularly to the Mediterranean for the 6th Fleet including Lebanon and Suez crises; otherwise operating out of New York on Atlantic/Caribbean fleet maneuvers. During the Cuban missile crisis she sailed for the Caribbean 23 October 1962 carrying reserve ammunition for quarantine-force ships and departed the area 16 December. Three 6th Fleet deployments with NATO exercises August 1963-July 1965; after a three-month overhaul she left Bethlehem Steel Shipyard, Hoboken, N.J., December 1966 for Guantanamo Bay refresher training. Spec block: dp. 13,910; l. 459'2"; b. 63'; dr. 28'3"; s. 16 k; cpl. 267; a. 1-5", 4-3", 4-40mm, 16-20mm; class line reads 'Wrangell.'

- Authoritative identity, construction, and service history; contains no asbestos, insulation, or hazardous-material information. The published DANFS text ends ca. 1967 (written while the ship was still in service) - it does not cover the 1968 Vietnam deployment or the 1973 decommissioning. 'Sailed to New York 2 November' is printed without year in the transcription and reads against the post-shakedown November 1945 timing (Wikipedia restates as 25 November 1945) - the DANFS framing is adopted for the record; see correction row.

- MARAD custody and disposition record: ShipHistory Detail 5932 identifies GREAT SITKIN (AE-17), year built 1945, North Carolina Shipbuilding Company, MARAD type C2-S-AJ1, naval auxiliary / AE ammunition ship, length 459.16 ft, beam 63.00 ft, 8,258 gross tons, fate 'Sold - Scrap,' Vietnam War mission flag. The two digitized status-card scans are primary documents: the MA-199 Vessel Status Card records official/vessel no. 0772306, MA hull M.C.-1706, builder's hull 197, 10,775 DWT, 'Date (Built) 2/19/45,' delivered from shipyard to 'U.S.M.C. (Loaned to U.S. Navy)'; operating history rows record USMC-to-Navy Department title transfer 1/14/46, Navy Department-to-Maritime Administration permanent transfer 2/25/74, and MARAD-to-Ship's Inc. 'Purchase' with remarks 'Scrap' 2/25/74. The MA-20 Record of Ship Sales (disposal PD-X-971, contract MA-7281) records award to Ship's, Inc. dated 2-25-74, purchase price $152,666.00, location of vessel Philadelphia, Pa., and remarks that the hull was advertised under PD-X-967 (bids rejected), then re-advertised under PD-X-971 as amended dated 1-17-74, bids opened 2-20-74, under two conditions '(1) NTU (2) SCRAP HULL-US,' award made under condition (2).

Ship note: 'Delivered 99.0% complete. Ferry comm. 19-21 Feb 45, converted by NYd Charleston (S.C.).' Class notes document that the C2-S-AJ1 differed from the standard C2 (full scantling rather than shelter-deck type, greater draft and tonnage), that all C2-AJ hulls were built at the Newport-News-operated wartime North Carolina Shipbuilding yard, that AE 16-19 were delivered incomplete but able to steam unarmed to conversion yards, and that November 1944 conversion specifications added underway-transfer capability for ammunition including aircraft bombs. The same notes record that when Korea broke out in 1950 all Mount Hood-class units except MOUNT KATMAI and GREAT SITKIN were in reserve - i.e., Great Sitkin remained continuously in commission.

- Finding
- Peer-reviewed historical study documents that asbestos was used extensively as a fireproofing and insulating material in U.S. shipbuilding during WWII - the era covering both this hull's Maritime Commission C2-S-AJ1 construction (Wilmington, N.C., keel November 1944 - February 1945) and her naval conversion to an ammunition ship at the Charleston Navy Yard (February-August 1945). The documented C2-S-AJ1 steam plant (header-type boilers at ~450 psi feeding a geared turbine) implies era-typical asbestos-relevant applications aboard a ship of this type: boiler and steam-drum insulation, steam-line lagging, valve and flange gaskets, machinery packing - and, for an ammunition ship, insulation of magazine/stowage spaces built to Navy conversion specifications.

The ship association's six command-history narrative pages and deck-log extracts contain zero mentions of 'asbestos' (full-text check of all six history files). The Naval Vessel Register carries no detail record for AE-17 (ships disposed before 1987 are not in the live register; the detail URL redirects to the site shell). The 1973-74 inactivation and 1974 Camden scrapping left no public hazmat/abatement documentation.
