[1]Dumas v. ABB Group, Inc., 46 F. Supp. 3d 477 (D. Del. 2014), Civ. No. 13-229-SLR-SRF (memorandum opinion, June 4, 2014; Fallon, M.J.) [court_record]

- Memorandum opinion, 'Facts' section (reciting D.I. 132 at 7-8; D.I. 322, Exs. A, B); also published at 2014 A.M.C. 1624, 2014 WL 2514492

- litigation_documented
- Finding
- Published federal opinion names this hull: reciting the complaint and plaintiff's exhibits, the court states plaintiff Arthur Dumas served in the U.S. Navy approximately June 1954 to August 1974 and alleges asbestos exposure 'at various naval stations and on naval ships,' the listed ships including 'the USS Guide, Franklin D. Roosevelt, Forrestal, Enterprise, Ogden, Tidewater, and Vulcan.' The opinion resolves only choice of law - maritime law held applicable to the asbestos personal-injury claims - and adjudicates no exposure. During 1954-1974 the only commissioned USS Guide was MSO-447 (the first Guide, AMc-83, was out of naval service after WWII), so the hull attribution is firm.

- Population
- Arthur Dumas (USN ~1954-1974); asbestosis alleged
- Limitations
- Pleading-stage allegation recited in a published choice-of-law opinion - the vessel list derives from the Second Amended Complaint (D.I. 132) and plaintiff's exhibits (D.I. 322, Exs. A, B), not from any adjudication; establishes that this hull was named in asbestos litigation, nothing more. Does not establish asbestos was aboard, individual exposure, causation, product identity, or legal eligibility. Plaintiff himself characterized the 'overwhelming majority' of his alleged exposure as relating to USS Forrestal and USS Enterprise. The later summary-judgment record does not develop service aboard Guide (see ev-uss-guide-am447-05).

- DANFS record for this hull: the second Guide was launched 17 April 1954 by the Seattle Shipbuilding & Drydocking Corp., Seattle, Wash., sponsored by Miss Ann L. Larson, and commissioned 15 March 1955, Lt. John E. Lowell in command (NHHC text reads 'John B. Lowell' - apparent typographical error; the NavSource commanding-officer list reads LT John Edward Lowell, USNA 1946); hull classification changed from AM-447 to MSO-447 on 7 February 1955. Service: first year coastwise off California incl. Navy Hydrographic Office surveys in the San Diego-Long Beach area and San Francisco Bay approaches; departed Long Beach 1 October 1956 for minesweeping exercises off Korea, the Marianas, and Japan; Far East deployments again 1959 (joint exercises with Japan, Korea, Nationalist China), 1961, and 1963; Vietnam 'Market Time' anti-infiltration patrols June-October 1965; off the Vietnam coast clearing shipping lanes from 1 March 1967. Spec block: dp. 665; l. 173'; b. 35'; dr. 11'; s. 12 k.; cpl. 75; a. 1 40mm; 'cl. Agile'.

- NavSource record for this hull: 'Aggressive Class Minesweeper'; laid down 20 February 1953 as AM-447 by the Seattle Shipbuilding and Dry Dock Corp., Seattle, WA; launched 17 April 1954; reclassified Ocean Minesweeper MSO-447 on 7 February 1955; commissioned 15 March 1955; decommissioned and struck from the Naval Register 9 July 1972; sold 27 January 1974 for scrap through the Defense Reutilization and Marketing Service to Al Kidman of Wilmington, CA for $26,601. Specifications: 630 t (lt) / 755 t (fl); length 172'; beam 35'; draft 10'; speed 14 kts; complement 80; as built one 40mm mount and two .50 cal machine guns (bow gun later replaced by twin 20mm); propulsion four Packard ID1700 diesel engines, two shafts, two controllable-pitch propellers.

The DRMS scrap-sale disposal conflicts with the hazegray DANFS transcriber's 'sold to Spain 1 January 1973' note - carried in gaps unresolved. Complement 80 conflicts with DANFS 75. [4]NavSource Mine Warfare index - 1950s MSO program description (65 ocean minesweepers 'built primarily of wood, with bronze and stainless (non-magnetic) steel fittings to minimize their magnetic signature'; Agile/Aggressive grouping, hull numbers 421-507) [other_primary]

- Finding
- Era/type inference: Guide is within the 1950s wooden-hulled ocean-minesweeper program (NavSource's index places MSO-447 in the AM-432 to AM-449 Aggressive block) - laminated wood hull with non-magnetic fittings and a diesel plant (four Packard ID1700s; no boilers, no steam system). For a mid-1950s Navy construction of this type, era-consistent asbestos applications would be confined to such uses as machinery gaskets and packing, electrical insulation, exhaust-system lagging, deck coverings and adhesives, and fireproofing - the boiler/fireroom and steam-line lagging profile of steam-driven steel ships does not apply to this type.

- Limitations
- Class/era inference only - no source names this hull's materials, and the MSO program description is class-level. Asbestos presence aboard this hull is neither established nor excluded: the type's diesel/wooden construction removes the steam-plant insulation pathway but does not establish which non-steam asbestos applications, if any, were actually fitted aboard this hull.

[5]In re Asbestos Litig. (Dumas v. ABB Group, Inc.), No. 13-229 - Report and Recommendation (D. Del. Sept. 30, 2015, D.I. 423; Fallon, M.J.); Memorandum and Order adopting R&R (Jan. 2016, Civ. No. 13-229-GMS; Sleet, J.) [court_record]

- Finding
- Later stage of the same action naming this hull at pleading: the R&R's deposition-level service summary recounts Dumas's service aboard USS Franklin D. Roosevelt (1956-57), the reserve fleet at Green Cove Springs, Fla. (1957), USS Forrestal (1958-60 and 1971-74), USS Enterprise (1960-63), shore duty (1963-67), USS Ogden (1967-69), USS Tidewater (to 1971), and USS Vulcan (about six months) - and does not describe service aboard USS Guide. The court adopted the R&R in January 2016, granting summary judgment to seven defendants (Electrolux, ABB, Velan Valve, GE, CBS, Foster Wheeler, Owens-Illinois) and denying or denying-in-part as to five (Buffalo, Ingersoll Rand, Aurora, IMO, Warren) on product-identification grounds.

- Discovery/summary-judgment record: confirms the Guide reference remained at the complaint vessel-list level and was not developed in the deposition testimony summarized by the R&R; no exposure finding for or against this hull was adjudicated, and the summary-judgment outcomes turned on product identification against individual defendants, not on conditions aboard this vessel. - Finding
- No qualifying ship-specific asbestos-materials record located: no hull survey, abatement contract, hazmat disclosure, government report, or adjudicated exposure finding naming AM-447/MSO-447 was found in the public sources searched. The only ship-specific asbestos-litigation record is the pleading-stage Dumas vessel-list naming (ev-01, ev-05). The CourtListener API sweep was rate-limit blocked before completion (2800/day cap exceeded mid-research); residual coverage via indexed-web checking surfaced the Dumas opinion and no other qualifying hit, but the opinion/docket index query remains incomplete.

- Limitations
- Absence of a located public record does not prove absence of asbestos aboard - the hull was disposed of in the mid-1970s, predating public ACM-survey practice. Does not establish that asbestos is or is not aboard; does not establish or defeat any exposure claim or legal eligibility. The blocked CourtListener sweep leaves residual litigation surface unexamined - logged honestly per batch rule rather than retried.
