[4]Walsh v. Air and Liquid Systems Corp., C.A. No. N15C-08-206 ASB (Del. Super. Ct. Oct. 27, 2017) (Scott, J.) - In re: Asbestos Litigation [court_record]

- Finding
- In consolidated asbestos litigation, the estate of Navy machinist Phillip A. Walsh alleged mesothelioma from asbestos exposure during 1975-1977 service aboard USS Halsey (CG-23) and USS Bigelow (DD-942). Walsh testified he worked in the ships' engine rooms replacing packing and flange gaskets, that some pumps and valves were insulated, and that he removed and applied insulation to equipment when making repairs. The opinion recounts that 'the ship records demonstrate that Buffalo pumps were present onboard both the Halsey and Bigelow' and that plaintiffs presented evidence Buffalo sold asbestos-containing pumps from 1955 through 1985. Buffalo Pumps' successor (Air and Liquid Systems) was nonetheless granted summary judgment: Walsh could not establish a permissible inference that he was exposed to asbestos-containing component parts for which that defendant was responsible.

- U.S. Navy machinist aboard USS Halsey engine room, 1975-1977; mesothelioma (alleged)
- Limitations
- Litigation-stage discipline: deposition/discovery-stage exposure testimony and plaintiffs' evidence, disposed at summary judgment for this defendant on product-identification grounds - a merits-level negative for this plaintiff, not an adjudicated finding that asbestos was or was not aboard. The Buffalo-pumps-aboard statement is the court's recounting of plaintiffs' evidence. Walsh's belief that parts contained asbestos rested on 'common knowledge' per the opinion. Does not establish causation, quantity, or any other individual's exposure.

- Locator
- Opinion at pp. 2-3; Delaware PDF also at courts.delaware.gov Download.aspx?id=265680
- Finding type
- litigation_documented
- Finding
- Same consolidated asbestos action: Walsh recalled Aurora as a manufacturer of pumps aboard USS Halsey and USS Bigelow and testified that pump replacement required pulling insulation off the pumps, removing old gaskets, and installing new packing and gaskets. Summary judgment for Aurora was granted - Walsh could not recall the maintenance history, how often he worked with Aurora pumps, or the pumps' types, so no permissible inference tied that defendant's asbestos parts to his exposure.

- Finding
- Same consolidated asbestos action: Walsh testified that aboard USS Halsey (and USS Bigelow) he pulled insulation off pumps, removed old gaskets, and installed new packing and gaskets during pump work in the engine room; he believed the parts contained asbestos because it was 'common knowledge.' This documents a major yard availability on this hull at Bath, Maine, 1971-1972 - consistent with the cruise book (moored at BIW 27 Oct 1971, out of commission special 4 Nov 1971, in commission 16 Dec 1972) and with the NVR delivery-date field of 12/08/1972.

- Finding
- Era and class inference: construction of a four-boiler, geared-turbine steam plant at a Navy shipyard in 1960-63 falls inside the documented naval asbestos-insulation era; era-typical applications for the type include boiler casing and steam-drum insulation, steam-line lagging, turbine insulation, valve and flange gaskets, machinery packing, deck coverings, and bulkhead/cable insulation. The fact file states the whole class received a late-1960s/early-1970s AAW upgrade (Terrier to Standard SM-1ER) and the late-1980s New Threat Upgrade: 'During the NTU overhaul, all spaces were renovated, berthing and food service areas were refurbished, and the engineering plant was fully overhauled' - a deep-disturbance availability type.

- Finding
- The authenticated opinion search for "USS Halsey" returned 5 hits: the three qualifying Walsh asbestos summary-judgment rulings naming this hull (ev-03/04/05); United States v. Diamond, 18 M.J. 305 (CMA 1984) - embezzlement court-martial of the disbursing officer aboard USS Halsey (CG 23), non-asbestos litigation that does name this hull; and United States v. Orozco (NMCCA 2014) - a name collision against the later USS Halsey (DDG-97). No additional qualifying asbestos opinion naming this hull was located in the completed searches. Hull-number ("DLG-23", "CG-23") and RECAP docket sweeps were blocked by the fleet-wide CourtListener pacing budget (momentarily spent, ~114/hr shared across sessions) and are logged as incomplete, not as no-result.
