- Primary ship-authored record (Feb 1946, cleared for public release by CinCPac) adding hull-level detail beyond DANFS: after commissioning at Orange the ship had 'a short period in drydock at Galveston, Texas' before Bermuda shakedown; recorded a 56-degree roll in a hurricane en route, earning the crew's nickname 'Mighty Mac'; conducted post-shakedown availability at Boston after screening her first ship to New York; Comdr. J. F. Way, USN, shifted his flag aboard making McGinty flagship of Escort Division 86; witnessed the 11 March 1945 kamikaze raid at Ulithi that damaged USS Randolph; from 30 April served as command/communications center for Surface Patrol and Escort Group 94.6 and Task Force 51 Escort Pool at Ulithi; at Kossol Roads served as SOPA and air-sea rescue ship guarding bypassed Babelthuap (Japanese garrison ~20,000); at Wakayama her crew set up an ashore communications center supporting POW evacuation under Escort Division 86; courier runs Wakayama-Yokosuka-Nagoya-Kure; second Christmas at Wakanoura Wan; departed for the U.S. 2 January 1946. CO roster appended: Cmdr. William H. Harrison (25 Sep 1944-10 Jun 1945), Lt. Comdr. Chandler Hovey Jr. (to 15 Oct 1945), Lt. Comdr. Edwin H. Kiefer (to decommissioning).

- Finding
- Qualifying asbestos litigation naming this hull. District-court orders recite: plaintiff Dale M. Spurlin served in the U.S. Navy 1963-1969; 'While on reserve duty, he spent one weekend a month on the McGinty, plus an 18-day cruise. Then, while on active duty from December 1964 through October 1966, Mr. Spurlin spent approximately two years straight on the Rowan. Mr. Spurlin was a boiler tender. He operated and maintained the boilers and related equipment in the fire rooms.' Plaintiffs alleged mesothelioma caused by 'asbestos-containing insulation, gaskets, and packing associated with handling Defendants' products.' The court denied defendants' Yearsley-immunity motion to dismiss failure-to-warn claims (Yearsley is an affirmative defense under Ninth Circuit law, not jurisdictional, and defendants did not show the absence of asbestos warnings was federally mandated), and on omnibus summary judgment found triable issues on duty to warn and causation as to all moving defendants except Tate Andale. The case proceeded to a jury verdict in favor of Foster Wheeler; the Ninth Circuit affirmed in an unpublished memorandum (1 December 2023) limited to jury-instruction issues (California consumer-expectation test; closing-argument challenges). The McGinty service period (1963-64 reserve drills) coincides with the hull's Portland Naval Reserve training era.

- Limitations
- Stage discipline: the exposure allegation reached the less-final dispositions only - a pleaded allegation that survived summary judgment (triable issues found), then a product-specific defense jury verdict for Foster Wheeler affirmed on instruction-error grounds; no court ever adjudicated that asbestos exposure occurred aboard this hull. The verdict is a merits-level negative for that plaintiff as to Foster Wheeler, not affirmative evidence and not an exposure finding. Boilers attributed to this hull's block are Combustion Engineering units (secondary block map), not Foster Wheeler - the complaint's product attribution for the McGinty fireroom service is not resolved in the indexed orders.

- Finding
- Era/design inference for a WGT steam escort built at Consolidated Steel, Orange, in 1944: the class carried a full steam plant - 2 superheated 'D' express boilers (the DE-339-372 block containing this hull maps to Combustion Engineering units per the class profile's navypedia block map) feeding Westinghouse geared turbines, 12,000 shp - so the period-standard asbestos categories apply at class level: boiler casing and machinery insulation, steam-line lagging, valve and flange gaskets, machinery packing, fireproofing, and deck coverings. Builder-yard context: the Orange yard expanded under Navy contract in 1940 and completed 12 Fletcher-class destroyers, 102 destroyer escorts, and 27 Gearing-class destroyers with a peak workforce of about 20,000 (Destroyer History Foundation). The yard is not in the Atlas shipyards.json dataset (carried in gaps).

- No hull-material record located: no ACM survey, abatement contract, hazmat disclosure, or material-condition report for this hull was found in the public sources searched. No preservation-era documentation can exist - the hull was sold for scrap in 1969 and was never a museum, memorial, or long-term reserve-fleet asset. The only ship-specific asbestos record is the Spurlin litigation (ev-04), an allegation that ended in a defense verdict. Marketing/law-firm ship-list pages naming DE-365 (asbestos-ships.com, mesotheliomabook.com) were located but are non-authoritative lead-gen sources and are excluded per batch rules - logged in the report, not cited as evidence.

- Finding
- CourtListener sweep complete (API v4, authenticated, fleet-paced): exact-name RECAP-docket query '"USS McGinty"' returned exactly one docket - Spurlin v. Foster Wheeler Energy Corp., S.D. Cal. 3:19-cv-02049 (docket 16382693) - qualifying asbestos litigation naming this hull (ev-04). Exact-name opinion query '"USS McGinty"' returned 0 results - the Spurlin orders sit in the RECAP docket, not the opinion corpus. Hull-number queries: '"DE-365"' type=o returned 27 results and type=r returned 161 results, all string collisions on snippet review (PACER docket-entry strings, Puerto Rican Spanish 'de 365' fragments, reporter text; zero vessel/Navy context in any snippet) - none vessel- or asbestos-related. '"McGinty" asbestos' type=o returned 23 results - led by McGinty v. Brown, 4 Vet. App. 428 (CAVC 1993), a name collision (claimant William M. McGinty alleged asbestosis from asbestos gloves as a 'hot-caseman' aboard USS Franklin D. Roosevelt and USS Coral Sea 1952-55; the vessel USS McGinty does not appear), plus asbestos-docket opinions where 'McGinty' occurs as a person/citation token with no vessel reference in snippet. 'Spurlin Foster Wheeler' opinion queries returned only collisions (Leutner v. State, Hauschild v. Roth) - the Spurlin orders and the 2023 Ninth Circuit memorandum are not in the opinion corpus. Classification: Spurlin = qualifying asbestos litigation naming this hull; McGinty v. Brown = name collision; all hull-number hits = string collisions; no other litigation naming this hull located.

Borg-Warner Morse Tec name USS Brannon (DE-446, a Consolidated-built sister hull) and recite a theory that a Griscom-Russell evaporator was supplied to the Navy per specifications and that insulation installed aboard was Navy-specified, with the era document suite identified (BuShips Manual ch. 39 'Thermal Insulation' NAVSHIPS 250-000(39), 1945; Navy Dept Specification 32F3a 'Felt, Insulating, Asbestos,' Oct 1945; BuEng Manual ch. 13; BUMED Code-55 memo 1977). - GAO documented the Navy's asbestos-protection program: standing policy (1975) removed asbestos insulation only when damaged or required for repairs, modified 1979 to selective replacement in high-maintenance areas. DE-365 was stricken in 1968 and sold for scrap in 1969 - before this policy regime took effect - so the hull's material state was governed by construction-era, in-service, and reserve-fleet practice, and no post-1975 abatement cycle applies to this vessel.
