- Finding
- Asbestos personal-injury litigation naming this hull with deposition-level detail: plaintiff Richard Wayne Rogers alleged mesothelioma from asbestos exposure at the DuPont Seaford plant and during U.S. Navy service 1966-1970. Per the Report and Recommendation, after September 1966 boot camp he was assigned to USS Moale (DD-693) at Newport, Rhode Island; he entered as a fireman and became a machinist mate, working in the engine rooms on pumps and evaporators, repacking leaking pumps ('pulling out wet packing and cutting rings of new packing with a knife'), and replacing pipe insulation 'by tearing off the pipe's covering, wetting insulation, and packing the insulation around the pipes.' A companion R&R recites his testimony that 'every pipe or steam line is wrapped with asbestos' and that he 'wet a material, made a paste, and packed the paste around the steam line.' Plaintiff also put National Archives ship records in evidence: the R&R notes 'National Archives entries regarding the USS Moale show that Warren [Pumps] supplied the main condenser circulating pump' (alleged shipped with asbestos-containing materials) and that the Moale's main propulsion engines contained General Electric turbines. The court recommended and then granted summary judgment to all five moving defendants (Warren Pumps, General Electric, Air & Liquid Systems, Charles A. Wagner, Asbestos Corp. Ltd.) on product-identification/causation grounds; Judge Noreika overruled objections, adopted the R&R, and granted the motions on 2019-08-07.

- 1966-1970 (alleged exposure, incl. Moale window ~1966-1967); litigation 2017-2019
- Population
- Richard Wayne Rogers (USN fireman/machinist mate aboard DD-693, ~Dec 1966-1967 per complaint; alleged exposure through 1970 service); mesothelioma
- Limitations
- Discovery/MSJ-stage record: the exposure account is deposition testimony and exhibits recited in an R&R, and the litigation ended in a defense summary-judgment win on product nexus - a merits-level negative for this plaintiff against those defendants, not a finding that asbestos was or was not aboard. The 'every pipe wrapped with asbestos' line is the plaintiff's testimony/belief, not an adjudicated fact. The R&R mislabels DD-693 'Fletcher-class' (it is Allen M. Sumner-class); hull number controls identity. On-ship window is disputed within the record: amended complaint ~1967; deposition and obituary suggest service to ~1970; ~Dec 1966 start is consistent. Does not establish causation, exposure dose, or present-day materials.

- Finding
- Court opinion naming this hull and a specific asbestos product: 'The plaintiff's March 4, 2005 disclosure revealed that Mr. Anderson's anticipated deposition testimony would identify Owens-Illinois Kaylo as one of the asbestos-containing products present on the U.S.S. Moale, the navy ship where plaintiff worked and was allegedly exposed to asbestos from 1955-1959.' Plaintiff's October 18, 2004 initial disclosures had already listed Owens-Illinois as manufacturer/supplier of 'Kaylo pipecovering and/or block insulation' associated with alleged exposure at a U.S. Navy work site 1955-1959. During 1955-1959 the only commissioned USS Moale was DD-693. Owens-Illinois removed on federal-officer grounds (28 U.S.C. 1442(a)(1)); the court granted the plaintiff's motion to remand to the Circuit Court of Marshall County, W. Va. for untimely removal without reaching the merits.

The quoted Kaylo product ID comes from anticipated deposition testimony (Master Chief BT M. Joe Anderson), not a finding. Does not establish causation, actual Kaylo presence aboard, or exposure quantity. State-court merits history after remand not located.

- Finding
- Pleading-stage allegation explicitly naming this hull: the Glenn wrongful-death complaint's exposure table lists the decedent as 'BOILER TENDER, UNITED STATES NAVY, 1945 to 1949' at 'Site: USS MOALE DD-693; USS ROGERS DD-876.' Hull number DD-693 makes ship identity unambiguous.

- Glenn decedent (USN boiler tender 1945-1949, alleged sites USS Moale DD-693 and USS Rogers DD-876); wrongful death
- Limitations
- Complaint recited inside a related-action notice - a double-removed pleading allegation, the least-final litigation stage; never adjudicated. Exposure is listed jointly for two hulls (DD-693 and DD-876) and cannot be apportioned between them. The 1945-1949 window spans Moale's early postwar period (Crossroads, Bremerton overhaul, Fleet Sonar School). No merits record located.

- Resolved as non-qualifying name reference: the fourth CourtListener docket-text hit for 'USS Moale' is a reproduced vintage Navy 'Bulletin Board' newsletter filed as a declaration exhibit in Gitto v. A.W. Chesterton (asbestos PI, S.D.N.Y.). The 'Moale' mention is a humor-column item about USS Moale (DD 693) crew consumption statistics during a Mediterranean tour ('96,840 cups of coffee... 812,400 cigarettes... 3770 bars of soap'). OCR-verified on the archive.org RECAP mirror (page 17 of the exhibit). No exposure allegation, product identification, or asbestos content relates to this hull.

[8]Owens-Illinois, Inc., Industrial Health Survey of Federal Shipbuilding and Dry Dock Co., Kearny, NJ (Aug. 30-Sep. 2, 1944); introduced as Owens-Illinois interrogatory exhibit #20 in Heathman v. - Finding
- Builder-yard evidence contemporaneous with this hull's construction era: the August 30-September 2, 1944 Owens-Illinois Industrial Health Survey at Federal Shipbuilding Kearny documented insulators cutting and fitting Johns-Manville Superex asbestos pipe covering and boiler insulation in confined shipyard spaces during the yard's wartime peak. Moale was launched there 16 January 1944 and commissioned 28 February 1944 - the survey post-dates her departure by about six months but documents the yard's standard wartime products and practices of the same period. The yard record also documents Owens-Illinois Kaylo at Kearny for the 1948-1958 period - the same product family the Roberts plaintiff's disclosures alleged aboard this hull for 1955-1959 (ev-02). Era inference: a Sumner-class destroyer built 1943-44 with a four-Babcock & Wilcox-boiler, 60,000-shp steam plant would have carried period-standard asbestos insulation, lagging, gaskets, packing, and fireproofing.

- Yard-level and era inference only - the survey does not name DD-693 or establish what materials were installed aboard this specific hull; it documents products in use at the builder's yard in the same construction era. The Kaylo yard window (1948-1958) and the alleged aboard-ship window (1955-1959) overlap but do not prove the product was aboard. Survey commissioned by a manufacturer with commercial interest; dust counts in mppcf.

- Finding
- Modernization-era inference: Moale completed FRAM II at Charleston Navy Yard in December 1961 - before the Navy's early-1970s asbestos substitution documented by GAO HRD-80-2 - so both original construction materials and 1961 yard work fall inside the documented asbestos-use era. FRAM II work on Sumner-class hulls rebuilt superstructure and systems (DASH deckhouse, torpedo tubes, sonar) and would have disturbed era insulation.
