Cal.), filed as MDL-875 Doc. 6548-2 (Jan 4, 2011); refiled in survival/wrongful-death action Turner et al. v. General Electric Co. et al., No. 3:12-cv-01600-EMC (N.D. Cal.), MDL-875 Doc. 8596-2 (Apr 2, 2012) (RECAP) [court_record]

    Finding type
    litigation_documented
    Finding
Asbestos personal-injury complaint Exhibit A lists NORTH CAROLINA (BB-55) among 31 vessels at Puget Sound Naval Shipyard, Bremerton, where plaintiff George W. Turner, a sheetmetal worker (helper) out of Shop 17, alleges he worked and was exposed to asbestos June 1944-September 1945; the complaint text states he worked 'on the ships listed above' near trades tearing out asbestos-containing insulation (asbestos cloth, pipecovering, cement) and carried damaged asbestos-containing insulation off the ships. Plaintiff was diagnosed with mesothelioma in or about May 2010; the identical ship list reappears in the 2012 survival/wrongful-death refiling.

    Population
Puget Sound Naval Shipyard sheetmetal worker (helper), Shop 17, 1944-45; mesothelioma
    Limitations
Pleading-stage allegation; the vessel is named among 31 ships at the yard, not an adjudicated finding of exposure aboard this hull. Does not establish which products were aboard, individual exposure, or causation. The ship's documented Puget Sound Navy Yard overhaul (summer-autumn 1944, after the Marianas campaign; rejoined carriers off Ulithi Nov 7, 1944) corroborates presence within the alleged window.

    Finding type

    Finding
An authentic construction-era Navy Department procurement schedule for 'Cable, electric, insulated, heat and flame resistant, on reels' itemizes quantities of Navy-type cable (DHFA, THFA, MHFA, NHFA, FHFA classes; SR1-3(S) armored) for delivery 'At BROOKLYN, N.Y., For USS NORTH CAROLINA (BB-55)' - a primary record of heat- and flame-resistant insulated cable procured for this specific hull during construction; schedule purpose line reads 'For BB-55 and BB-56' under Project Orders Nos. 129 and 130/RNV(CAM), with a parallel delivery block for USS WASHINGTON (BB-56) at Philadelphia. Cable is specified to Navy Supplementary General Specifications for Machinery SGS(62)-128b, -157a, and -158a and Specification 15-C-1i.

New York Navy Yard construction/supply context, 1939-41
    Limitations
Period procurement document filed as a defense-side expert exhibit in asbestos litigation; it names cable types and the destination hull but does not state fiber content. Association of WWII Navy 'FA'-family heat/flame-resistant cable insulation with asbestos is era-specification inference. Not an adjudicated exposure finding; does not quantify material aboard this hull. CORRECTED: bid date reads March 18, 1939 (opening March 21, 1939) per direct exhibit read 2026-09-18 - the batch-06 record and class profile carried 'Aug 29, 1940'.

    Finding
As built 1937-41, North Carolina's eight-boiler, four-turbine steam plant (four segregated main machinery spaces - two boilers and one turbine per shaft, per the NHL nomination) and associated steam piping, valves, and auxiliaries were insulated under late-1930s Navy specifications; boiler/fireroom insulation, steam-line lagging, deck tile, and bulkhead materials were standard class-era asbestos applications.

    Limitations
Class/era inference only - no hull-specific insulation survey located. Names the era standard, not confirmed installed materials on this hull; no quantity; does not establish what remains aboard today.

    Finding
Documented exposure-relevant work periods for this hull: construction at New York Navy Yard 1937-41; Pearl Harbor repairs after the Sep 15, 1942 torpedo hit and availabilities March-April and September 1943; overhaul at Puget Sound Navy Yard summer-autumn 1944; postwar overhaul at New York; decommissioned at New York Jun 27, 1947 and laid up in the Bayonne, NJ reserve fleet until 1961; stricken Jun 1, 1960; transferred to North Carolina Sep 6, 1961; towed to Wilmington Oct 1961 and dedicated as the state WWII memorial Apr 29, 1962. Per the museum she has never been drydocked since 1947: Operation Ship Shape (1998) replaced the teak main deck and test-repaired wind/water-line steel under a temporary cofferdam; a permanent 1,909-foot cofferdam (Generations Campaign, 2017) enabled roughly 1,800 sq ft of hull steel and framing to be cut out and replaced in place in 2021 (NUCOR-donated steel); forward mast repaired 2022. NHL nomination finds the ship 'essentially unaltered since she was mothballed... in 1947.'

New York Navy Yard, Pearl Harbor, and Puget Sound yard trades; crew; museum restoration contractors (1998, 2017-2022)
    Limitations
The yard periods and museum projects are ship-specific and documented; the asbestos rip-out/re-insulation scope of each is inferred from era practice, not documented per-hull. No asbestos component is documented in the public record of any museum project (deck, cofferdam, hull steel, mast). The NHL 'essentially unaltered' statement is an integrity finding, not a hazmat survey - not promoted to asbestos evidence. Does not establish exposure for any individual.

    Limitations
Absence of a located public record does not prove absence of asbestos aboard - the ship retains substantial WWII-era fabric per the NHL nomination and has never been drydocked since 1947. Does not establish that asbestos is or is not present; does not establish or defeat any claim of exposure or legal eligibility.
