[2]Sclafani v. Air & Liquid Systems Corp., 14 F. Supp. 3d 1351 (C.D. Cal. Apr. 17, 2014), Order on Joint Defense Motion for Summary Judgment Regarding Causation (Wilson, J.), No. CV 12-3013 SVW [court_record]

- Finding
- Published federal summary-judgment opinion names this hull: 'Decedent David Sclafani enlisted in the Navy in January of 1960, serving as a boiler technician aboard the U.S.S. Morton from 1960 until 1963 and the U.S.S. Rogers for approximately six months in 1963. Among other things, Sclafani performed maintenance and repair work on various pumps, valves, and boilers aboard each ship. Sclafani claims that while working with these pumps, valves, and boilers, he inhaled asbestos-laden dust which later caused him to develop mesothelioma, the disease that caused his death.' It was undisputed that Sclafani died of mesothelioma. The court granted the joint defense motion for summary judgment - plaintiffs' causation evidence as to each remaining defendant's particular product (Cranite gaskets; Foster Wheeler boiler work) was speculative on frequency, regularity, and proximity, and the 'every exposure' expert opinions were excluded (Daubert) or inadmissible (Rule 26). Air & Liquid Systems (successor to Buffalo Pumps) had settled before the order. The only commissioned USS Rogers during 1963 was DD-876 (DDR-876 until 30 July 1963).

- Navy boiler technician aboard USS Rogers ~6 months 1963; USS Morton 1960-1963
- Limitations
- Merits-stage disposition AGAINST plaintiffs: the opinion recites, but does not adjudicate, asbestos exposure aboard this hull - causation to any particular defendant's product failed at summary judgment. Establishes that service aboard USS Rogers by a boiler technician in 1963 is an undisputed fact of record in a mesothelioma wrongful-death action; does not establish that asbestos products were present aboard, does not identify or quantify products, and does not support individual-exposure findings.

- Finding
- Asbestos personal-injury complaint exhibit names this hull by hull number: plaintiff Ted Munn's Exhibit A 'Location of Exposure' table lists 'U.S. Navy - USS Rogers (DD/DDR-876) Boiler Technician - San Diego; Charleston, South Carolina; Korea - 1959-1963' followed by 'Ingalls Shipbuilding Plant, Pascagoula, Mississippi - Crane Operator - 1964-1968.' The complaint expressly disclaims 'any cause of action or recovery for any injuries resulting from exposure to asbestos dust that occurred in a federal enclave, which expressly excludes U.S. Navy vessels' - a jurisdictional disclaimer, yet the hull is named in the pleading's exposure table. Munn's Charleston, S.C. service window overlaps this hull's documented FRAM I modernization at Charleston Naval Shipyard (June 1963-May 1964).

- Wrongful-death asbestos complaint names this hull by hull number within a yard-worker's comprehensive ship list: heirs of Robert Hilt alleged he worked at Hunters Point Naval Shipyard as Laborer (1965) and Marine Machinist helper (1966-1972), and the complaint's 'Location of Exposure' table lists 'ROGERS (DD-876; DDR-876) 1965-1971' as line 13 of a ~60-vessel alphabetical schedule of ships present at or worked on around the yard (Anderson DD-786, Richard S. - Pleading-stage allegation only - unadjudicated complaint exhibit (scanned image; read via local OCR). Weakest of this record's named references: DD-876 is one of ~60+ vessels in a blanket yard-presence schedule, not an allegation of service aboard - the claim is yard-worker exposure, with Rogers as one ship among many at Hunter's Point during 1965-1971. No vessel-specific exposure mechanism, duration, or product is pled as to this hull. DANFS confirms a Hunter's Point overhaul but at dates inconsistent with the complaint's 1965-71 window (chronology conflict carried in gaps).

- Published Veterans Appeals opinion names this hull: the court recites that veteran Ray J. Jeffers (USN 1944-1964) 'was aboard the USS ROGERS in 1948 and that he did indeed take part in Operation Sandstone' (the Eniwetok atomic tests). His widow sought service connection for the bronchogenic carcinoma that killed him in 1980; the BVA's 1981 denial concluded the cancer 'was neither related etiologically to exposure to radiation or asbestos,' and the pleaded theory at the CAVC was ionizing radiation from Operation Sandstone. The court granted summary affirmance of the denial.

- DANFS record for this hull: named for three brothers (Jack Ellis Jr., Charles Ethbert, Edwin Keith Rogers) killed aboard USS New Orleans (CA-32) at Tassafaronga 30 Nov 1942. Laid down 3 June 1944 by Consolidated Steel Co., Orange, Tex.; launched 20 November 1944, sponsored by Mrs. J. E. Rogers, Sr.; commissioned 26 March 1945 (Comdr. C. B. Smiley). - Finding
- Class/era inference for this hull: a Gearing-class destroyer built 1944-45 with four Babcock & Wilcox superheated boilers and 60,000-shp geared steam turbines at the peak of Navy asbestos use would have carried boiler and fireroom insulation, steam-pipe lagging, turbine lagging, valve/flange gaskets and packing, and compartment insulation as era standard. The Goodrich omnibus opinion (E.D. Va. 2018) recites that 'an engineering drawing for the insulation and lagging of forced draft blower turbines for the class of destroyers (DD 692, USS Allen M. Sumner class), within which the USS Harlan Dickson fell, specifies the use of amosite felts and asbestos cloths' and quotes a report estimating a 'partial tally' of 30.3 tons of asbestos thermal insulation and lagging in fire and engine rooms of Sumner/Gearing-class destroyers - the Gearing design was a 14-ft hull lengthening of the Sumner machinery arrangement. Sclafani/Munn/Morris/Glenn allegations against this hull all concern boiler-room and machinery maintenance consistent with this class picture.

- Program-level context applicable to this hull's service era: GAO documented that Navy policy from 1975 removed asbestos insulation only when damaged or when required for repairs, modified in 1979 to selective replacement in high-maintenance areas - meaning original-era insulation typically remained in place aboard ships of this vintage for decades unless disturbed by a yard period.
