[4]Hasenberg v. Asbestos Corp. Ltd. et al., No. 13-cv-01325-SMY-SCW (S.D. Ill.), Memorandum and Order denying summary-judgment motions of Air & Liquid Systems Corp. (successor to Buffalo Pump) and Warren Pumps LLC (Mar. 18, 2015) (Yandle, J.) - verbatim order PDF via Wolters Kluwer PLSD; same docket earlier captioned Hasenberg v. - Finding
- Merits-stage order recites that plaintiff William Hasenberg served in the U.S. Navy 1968-1972, working as a boiler technician aboard USS Bausell (Nov 1970-Sep 1971) and then USS Sterett, on which he served until July 1972 (the order text reads 'transferred... in September 1970' - internally inconsistent with the Bausell window and carried as a scrivener's slip). Aboard Sterett his duties matched those on Bausell: removing packing from pumps with a hook tool so it broke apart, and changing flange gaskets with scraper and wire brush, breathing airborne particles; force-air blowers in the engineering spaces spread the particles; and even when not working on a pump he entered the engineering spaces two to three times a month to take measurements or retrieve equipment, where other crew members were engaged in the same gasket-and-packing work. Holding that 'a reasonable jury could infer that Plaintiff was exposed to asbestos-containing products from both companies while performing his duties aboard both ships,' the court DENIED both defendants' motions for summary judgment. The companion complaint alleged lung cancer (per the Apr. 9, 2014 threshold order in the same docket).

- Population
- U.S. Navy boiler technician aboard USS Sterett (DLG-31), to July 1972; lung cancer (as alleged in the complaint)
- Limitations
- Summary-judgment-stage record: the court found a genuine issue of material fact - a triable inference - not an adjudicated finding that exposure occurred or that defendants' products caused disease; no verdict or appellate record located. Does not quantify exposure, does not establish causation for any other individual, and says nothing about remaining material aboard. Outcome of the case after March 2015 not located.

[5]Hasenberg v. Asbestos Corp. Ltd. et al., No. 13-cv-01325-SMY-SCW (S.D. Ill., Mar. 18, 2015), Memorandum and Order - defendant-supply recitals (Docs. 371-11, 372-3 through 372-5, 371-5, 371-8) [court_record]
- Locator
- M&O p. 3 (Buffalo/Warren records recital; 'Warren supplied the Sterett with the main condenser circulating pump')
- Finding type
- litigation_product_id
- Finding
- The same order recites product identification tied to this hull: 'Warren supplied the Sterett with the main condenser circulating pump' (citing Doc. 371-11); the plaintiff identified pumps he worked on aboard Sterett as Buffalo- and Warren-made (Docs. 342-2, 372-2); Buffalo's records showed it 'sold asbestos-containing gasket and packing material to the Navy' (Doc. 372-5); and Warren 'sold and distributed pumps to the Navy with asbestos-containing packing and gaskets' and sold asbestos-containing replacement gaskets and packing shown by Navy invoices (Docs. 371-5, 371-8). On that record the court credited the inference that the materials the plaintiff disturbed aboard the ships were the defendants' asbestos-containing components.

- Limitations
- Product identification at discovery stage: Warren's supply of the main condenser circulating pump to this hull is recited from cited exhibits (Doc. 371-11), but the asbestos content of the specific packing/gaskets the plaintiff disturbed is inferred circumstantially from defendants' Navy sales records rather than part-level documentation for this hull; nothing was adjudicated at trial.

- Finding
- Docketed asbestos complaint: Terry Lee Siegfried, an electrician/marine electrician at Long Beach Naval Shipyard c.1969-1996, listed 'Sterett (CG-31)' among 43 vessels in the single undifferentiated 'Location of Exposure' cell of Exhibit A; the complaint recites malignant mesothelioma diagnosed on or about October 2017. Hull number CG-31 is unambiguous - only this Sterett carried it.

Edward A. Christofferson, Jr., in command. Post-shakedown availability at PSNS January-March 1968; homeport Long Beach; Tonkin Gulf PIRAZ/SAR/strike-support service 1968-1973 including the 19 April 1972 Dong Hoi engagement (Terrier salvo downed a MiG; a second salvo destroyed a probable Styx missile in midair); five-month Long Beach Naval Shipyard overhaul October 1970-March 1971 (Navy Distillate fuel conversion, weapons modifications); nine Vietnam battle stars. Reclassified CG-31 on 30 June 1975; decommissioned and stricken 24 March 1994 at San Diego; transferred to the Maritime Administration 12 May 1994 and laid up at the Suisun Bay reserve pending disposal. - Era inference: Belknap-class steam-driven construction (class spec: four 1,200-psi boilers, two geared turbine sets, twin screw, ~85,000 shp) built 1962-1967 at Puget Sound Naval Shipyard falls within the Navy's peak asbestos-use era, and both the builder yard and the repeated Long Beach Naval Shipyard overhaul venue (1970-71, 1974, 1979-80) are documented asbestos-exposure sites in the Atlas yard dataset. Era-consistent applications for this plant: boiler casing insulation, steam-line lagging, turbine lagging, valve and flange gaskets and packing, deck tile, bulkhead fireproofing, cable insulation.

- Locator
- GAO product page HRD-80-2
- Finding type
- gov_survey
- Finding
- GAO documented the Navy's extensive shipboard asbestos insulation use and its worker-protection program; the Navy's standing policy left installed asbestos insulation in place unless damaged or disturbed by repairs - meaning original-era insulation typically remained aboard for decades until a yard period disturbed it. Sterett's service life (1967-1994) spans both the pre-substitution construction era and the removal-policy era, and her three documented Long Beach yard periods (1970-71, 1974, 1979-80) plus the 1991-92 Southwest Marine overhaul are the classic disturbance pathways.

CourtListener API v4 was throttled this session (HTTP 429; 125/day shared quota exhausted, expected-available escalation observed), so litigation identification rests on site-scoped web search of indexed CourtListener/RECAP content plus direct RECAP document pulls; a fresh full API search remains an open task.
