- DANFS documents identity, construction, and service history, not materials or asbestos content. Its phrasing places the Navy-list strike at the 30 November 1963 decommissioning, conflicting with the secondary-consensus 1 November 1965 strike date - carried in gaps. [3]Livernois v. Air & Liquid Systems Corp. et al., No. 4:19-cv-02277-SBA (N.D. Cal., CourtListener docket 15007829; filed 2019-04-26, terminated 2019-07-30; Nature of Suit 365 Personal Inj. Prod. Liability), NASSCO's Notice of Removal, ECF No. 1; removed from Alameda County Super. Ct. No. RG18904408; earlier posture: Livernois v. NASSCO, No. 3:18-cv-01326-BEN-JMA (S.D. Cal.) [court_record]
- Locator
- ECF No. 1 (Notice of Removal), 'Grounds For Removal' para. 26, p.8 of stamped PDF (RECAP gov.uscourts.cand.341364.1.0)
- Finding type
- litigation_documented
- Finding
- Qualifying pleading-stage asbestos litigation naming this hull: the removal notice recites plaintiff William Livernois's allegation that, as a Navy boiler tender approximately 1957-1978, he developed mesothelioma from exposure to asbestos-containing products aboard U.S. Navy vessels 'undergoing construction, repairs and/or modifications at or near NASSCO in San Diego,' the vessels including 'USS Norfolk, USS Charles Sperry, USS Edison, USS Tingey, USS O'Brien, USS Picking, USS Haley Powell, and USS Rowen.' DD-539 was the only USS Tingey in commission during 1957-1963 (Tingey I, TB-34, sold 1920; Tingey II, DD-272, scrapped 1936), and it was homeported San Diego as a reserve training ship 1957-62.

- 1957-1963 (alleged exposure window for DD-539); 2018-2019 (litigation)
- Population
- William Livernois (USN boiler tender, approx. 1957-1978; mesothelioma)
- Limitations
- Pleading-stage allegation only - the vessel list is an allegation recited in a defendant's removal notice, not an adjudicated finding; the docket terminated 2019-07-30 (about three months after removal) with no adjudication of the exposure allegations. It does not establish causation, asbestos content or quantity aboard this hull, product identity, or legal eligibility. Exposure is alleged at/near a repair yard (NASSCO) rather than necessarily during steaming service.

[4]DANFS specifications block (Fletcher class; 37 kt) + Atlas shipyard dataset records 'bethlehem-shipbuilding' (tier 3, incl. documented products list and workforce findings) and 'mare-island-naval-shipyard' (tier 2) [other_primary]
- Locator
- DANFS specifications block; shipyards.json records 'bethlehem-shipbuilding' and 'mare-island-naval-shipyard'
- Finding type
- asbestos_application
- Finding
- Era/yard inference: a Fletcher-class destroyer built 1942-43 with a four-boiler, 60,000-shp steam plant would have carried period-standard asbestos insulation, lagging, gaskets, packing, fireproofing, and deck coverings. The builder yard is documented at yard level in the Atlas dataset (bethlehem-shipbuilding, tier 3); Mare Island Naval Shipyard, where this hull moored 9 July 1945 through war's end, is also documented at yard level (tier 2).

- Limitations
- Class/era and builder-yard inference only - NOT a ship-specific finding; the ship-specific asbestos-adjacent record for this hull is ev-02 (Livernois allegation). Yard records document yard conditions and product use, not materials installed aboard DD-539. Does not quantify material or establish any individual's exposure.

- Finding type

- Finding
- GAO documented that the Navy used asbestos insulation extensively aboard ships and did not begin substituting alternative insulation materials until the early 1970s - placing this hull's entire service life (1943-1963) inside the documented asbestos-use era.

- Locator
- pier70sf.org ShipsBuiltWW2 table, row for yard hull 5390
- Finding type
- historical_record
- Finding
- The Pier 70 (San Francisco) ships-built table lists this hull as yard hull no. 5390: 'Tingey, DD - Destroyer, 539,' contract year 1940, keel 10/22/42, launch 5/28/43, delivery/commission 11/25/43, fate 'Sunk as target 1966' - corroborating DANFS dates and identifying the builder yard as Bethlehem's Pier 70 plant.

- Finding type
- historical_record
- Finding
- Post-1963 disposition rests on secondary consensus: stricken from the Naval Vessel Register 1 November 1965 and sunk as a target in May 1966. ub88.org's Fletcher identification research gives the most specific disposition - sunk as target 5/1/66 off San Clemente Island - while the NavSource-derived record (navsource.org, uboat.net, Wikipedia, navalcovermuseum.org, hullnumber.com) reads 'sunk as a target off San Francisco in May 1966.' DANFS documents only that the ship was decommissioned 30 November 1963 'and her name was struck from the Navy list,' implying strike at decommissioning.

- Finding
- No ship-specific asbestos material record located: no asbestos survey, material inventory, abatement contract, or hazmat disclosure for DD-539 exists in the public sources searched (see search_ledger). The hull was sunk as a target in 1966, so no present-day survey is possible. The only ship-specific asbestos-adjacent record is the pleading-stage Livernois allegation (ev-02).

- Finding
- Complete CourtListener sweep for this hull: opinions 'USS Tingey' = 0; opinions 'DD-539' = 0; dockets 'USS Tingey' = 1 (the qualifying Livernois docket 15007829, ev-02); broad 'Tingey' opinions = 672 hits, all surname collisions (e.g., State v. Tingey, Tingey v. Haisch, Tingey v. Pixley-Richards) with no vessel reference. No indexed opinion names the ship; the only qualifying litigation is the pleading-stage Livernois docket.

- Limitations
- Zero indexed opinions is not proof no case exists - pleading-stage RECAP documents (e.g., the Livernois removal notice) are not indexed as opinions, and state-court filings outside RECAP coverage are invisible to this sweep. The sweep confirms no adjudicated/published asbestos opinion names this hull.
