- Docketed asbestos action with ship-specific evidence surviving summary judgment: Pruitt v. Air & Liquid Systems Corp., C.A. No. 18-1101-MN-SRF (D. Del., In re: Asbestos Litigation), filed 2018-07-26. Plaintiff John W. Pruitt, Sr., a Navy machinist mate stationed aboard USS Tolovana from 1959 (first Tolovana year per the R&R; companion R&R states Navy service September 1959-April 1962), alleged mesothelioma (diagnosed May 2018) from asbestos-containing products during Navy service and later civilian work at Schroer Implement Co. Shipfitter 3/c Edmond Dumas (aboard Tolovana September 1960-December 1963) testified as fact/product-identification witness to Pruitt's gasket- and packing-replacement work on cargo, JP-5, avgas, fire/general-service, fuel-transfer, and diesel emergency fire pumps in the midship and aft pump rooms, producing visible dust Pruitt breathed. Magistrate Judge Fallon's Report and Recommendation (D.I. 399, dated 2020-07-30) recommended granting Amdura and BorgWarner summary judgment but DENYING Gardner Denver and Warren Pumps; District Judge Noreika's Memorandum Opinion and Order (2020-09-23) overruled the defendants' objections, ADOPTED the report, and DENIED both motions.

- Limitations
- Classified at discovery/summary-judgment stage per batch discipline: the court held only that a reasonable jury COULD find exposure to asbestos-containing Gardner Denver and Warren Pumps products aboard this hull - it did not find that asbestos was aboard, that Pruitt was exposed, or that any product caused injury. No trial verdict, judgment, or appellate review was located; terminal disposition after the September-November 2020 rulings (likely settlement) is a gap. The Report's reliance on the withdrawn Lowell affidavit was expressly noted as harmless error after substitution of the Moore affidavit.

- Gardner Denver diesel emergency fire pump identified aboard Tolovana by ship records and undisputed by the defendant: the ship's July 1972 general information book lists Gardner Denver as manufacturer of the single diesel emergency fire pump, located in the forward pump room; records showed only one such pump aboard, and 'Gardner Denver does not dispute that they manufactured the single diesel emergency fire pump located on the USS Tolovana during Mr. Pruitt's service.' Plaintiff's expert Capt. Arnold Moore opined (D.I. 365, Ex. H at 9): 'one Gardner Denver horizontal centrifugal emergency fire pump driven by a diesel engine was installed in the forward pump room on TOLOVANA ... it is clear that one Gardner Denver fire pump was installed on TOLOVANA during construction and remained aboard throughout Mr. Pruitt's service. Gardner Denver drawings AIA-158A110 and AIA-158A-111 record Gardner Denver fire pumps utilized braided asbestos packing. Navy specifications for water pumps, including fire pumps, required that the casings for these pumps be sealed with compressed asbestos sheet gaskets.' Dumas testified to observing Pruitt replace the pump's gaskets and packing (1-2 hours, breathing 'dust and particles'), though Dumas placed the work in the aft section while records place the pump forward - the court held the discrepancy was a jury question, not fatal.

- Limitations
- Ship-specific product identification reaching the discovery-tested stage: ship records (1972 general information book, Sparrows Point machinery list) + defendant's non-denial establish the pump aboard; the asbestos content (braided packing, compressed sheet gaskets) is expert opinion quoting manufacturer drawings and Navy specifications, tested only for summary-judgment sufficiency - not an adjudicated fact. The asbestos statements describe the pump TYPE and Navy spec requirements, which is stronger than pure era inference but short of a materials test of this hull's pump.

- Warren Pumps fire/general-service and fuel-oil-transfer pumps identified aboard Tolovana circumstantially: 1952 and 1972 ship records (pre- and post-dating Pruitt's service) created a genuine issue as to whether those pumps - located in the engine room where Pruitt spent the 'vast majority' of his time - were Warren Pumps products; Warren Pumps discovery materials from other cases and a 1961 Warren fire-pump instruction manual supported a jury question on asbestos-containing gaskets/packing and replacement parts supplied to the Navy; Capt. Moore opined the pumps were Warren-manufactured, remained aboard throughout Pruitt's service, and 'would have been insulated with 85% magnesia, an insulating material containing 15% asbestos fiber.' Dumas observed Pruitt's general maintenance on a fire general service pump and fuel transfer pump every 1-2 months, 2-3 hours, producing visible dust Pruitt breathed.

- Weaker identification than the Gardner Denver pump: neither plaintiff nor Dumas named Warren Pumps, and identification rests on circumstantial ship records plus expert opinion. - Defense-side merits results within the same Pruitt record (negative findings for the plaintiff, not exposure evidence): Amdura (successor to American Hoist & Derrick) GRANTED summary judgment - the AH&D winch records relied on (1943 and 1952) predated Pruitt's service, the shipboard winch universe was not limited to AH&D, and the winch sizes he worked on matched none of the listed AH&D winches; 'the mere presence of AH&D winches on board the USS Tolovana is insufficient to establish causation.' BorgWarner GRANTED (Bendix clutch friction exposure was land-based at Schroer, Georgia law). A companion R&R granted unopposed summary judgment to Taco, Terex, and Trane and partial summary judgment to Deere (negligence claim surviving only as to original Deere-manufactured parts exposure). A November 9, 2020 R&R recommended dismissing Doe defendants 1-350 for failure to identify any within the discovery deadline.

- Merits-level negatives for those defendants only - they narrow the surviving product-identification record to the Gardner Denver fire pump and the Warren Pumps units; they say nothing about asbestos presence or absence aboard the ship generally. The winch claim's failure illustrates why a mere shipboard-presence record (machinery list) does not equal exposure evidence.

- Second docketed asbestos action naming the hull: Quirin v. Lorillard Tobacco Co. (filed as Quirin v. Alcatel-Lucent USA Inc. et al.), No. 1:13-cv-02633 (N.D. Ill., Gottschall, J.), removed from the Circuit Court of Cook County April 2013. Ronald J. Quirin enlisted September 1953 and served aboard USS Tolovana - described in the opinion as 'a fleet tanker based in Long Beach, California' - from May 1954 to August 1957 as apprentice machinist then machinist mate; diagnosed with mesothelioma on or about 2011-12-27, died 2013-03-31; suit by his widow/executor Marilyn F. Quirin. Two published summary-judgment rulings: (a) Crane Co.'s motion DENIED, 17 F. Supp. 3d 760 (2014-02-14) - genuine dispute on duty to warn and proximate cause under maritime law for asbestos-containing gaskets, packing, pipe covering, and insulation used with Crane valves; (b) Lorillard/Hollingsworth & Vose motion DENIED, 23 F. Supp. 3d 914 (2014-02-26) - reasonable jury could find Quirin smoked original Kent cigarettes with asbestos-containing Micronite filters beginning aboard the Tolovana ~mid-1954. A Daubert ruling (~2014-02-25) admitted plaintiff experts Millette and Brodkin. Docket shows Georgia-Pacific and Crane settled 2015-02-12 and 'Case called for trial. The Lorillard/H&V exposure theory (Kent Micronite cigarettes smoked aboard) places an asbestos product at the situs but documents no shipboard-installed material. The Crane opinion's 'over a thousand Crane valves' figure rests on the expert's review of construction documents produced in litigation - the underlying documents are not reproduced in the opinion. The 2015 settlement minute entries are read from the Plainsite docket mirror (non-official aggregator); the reported F. - Finding
- Crane Co. valves and associated asbestos components identified aboard Tolovana in the Quirin record: plaintiff's Navy-practices expert Captain William Lowell testified he reviewed original-construction documents indicating the ship 'utilized over a thousand Crane Co. valves'; Quirin recalled Crane as the main valve brand aboard (embossed). Crane valves were metal (not themselves the fiber source); the claim was that they carried or required asbestos-containing bonnet gaskets and stem packing - Lowell: 'more likely than not' Crane valves had asbestos packing and non-metallic bonnets had sheet asbestos gaskets - and that Crane separately sold 'Cranite' sheet packing (75-85% asbestos, sold ~1920 to mid-1970s, never offered asbestos-free) plus resold Garlock/Johns-Manville asbestos components. Lowell further testified that Maritime Administration specifications for T3-S2 tankers 'such as the Tolovana' specified 85% magnesia insulation (up to 15% asbestos) and in his opinion that insulation would have been used on the ship - he did not know the insulation manufacturer. Quirin testified to fabricating gaskets from sheet stock, chiseling/brushing flange gaskets, and removing stem packing, creating dust and fiber he breathed. Court rejected strict 'bare metal' defense, adopting the middle-path duty theory.

- Peer-reviewed historical scholarship documents that asbestos was used extensively as a fireproofing and insulating material in U.S. shipbuilding during World War II - the era in which this hull was constructed (1944-45) and in which the Pruitt expert located asbestos packing, gaskets, and magnesia insulation aboard.

- Limitations
- Program/era-level documentation of wartime shipbuilding asbestos use generally; does not name this vessel and cannot establish asbestos aboard this specific hull - context only, per batch rule against class/era inference.

- Finding
- The building yard has its own Atlas-documented asbestos record: the bethlehem-shipbuilding shipyard profile (yard covering Sparrows Point among Bethlehem facilities) documents asbestos-containing products including 85% magnesia block insulation, Marinite board, Transite pipe covering, Unibestos products, asbestos lagging, gaskets and packing materials, and compressed asbestos sheets - consistent with, but independent of, the Pruitt expert's description of pump packing/gasket/magnesia materials aboard this hull.

- Limitations
- Yard-level documentation only. The yard record aggregates Bethlehem facilities and does not attribute specific products to this specific hull; used to contextualize construction-era exposure pathways, never as a ship-specific finding.

- Finding
- Negative findings: aside from the Pruitt (ev-05/06/07/08) and Quirin (ev-09/10) litigation records, no asbestos survey, abatement contract, insulation schedule, hazmat disclosure, or adjudicated exposure finding was located for this hull. CourtListener exact-name sweep 'Tolovana' (22 opinions) returned the two Quirin clusters as the only qualifying hits - all others name collisions on the Oregon inn/Alaska mining district; 'AO-64' sweep (1047 hits) is a high-collision token with no ship match on the reviewed page; exact-phrase 'USS Tolovana' query was throttled by the fleet limiter and is superseded by the completed name sweep. The Bureau of Ships War Damage Report index (HyperWar) contains no Tolovana report - consistent with DANFS 'no combat damage.' No BVA decision naming Tolovana or AO-64 located in the general-web sweep (VA decision-search endpoint unreachable from this session; a VA News veteran-profile mention is not an asbestos adjudication). No NHHC Online Library ship page or HyperWar DANFS transcription located.

- Limitations
- Absence of a located public record does not prove absence of asbestos - a 1945 steam-plant fleet oiler is era-consistent with asbestos use, and two litigation records document allegations to that effect. Negative findings reflect the limits of publicly indexed sources: the exact-phrase CourtListener sweep was superseded mid-throttle by the completed name sweep; the VA endpoint and live NHHC/NavSource links were unreachable.

- Finding
- Archival leads not retrieved (research-room or reproduction order required; no spend authorized): NARA RG 24 Navy deck logs cover this hull's commissioned periods (1945-49, 1951-75) and would log underway replenishment and availability periods; RG 178/RG 19 hull records may hold the construction specification and the ship's Booklet of General Plans; the ship's 1972 general information book and the Sparrows Point machinery list cited in Pruitt survive in the litigation record/discovery exhibits and would be the fastest route to a material schedule; NAID 7573652 is the NARA-held 1957 Hunters Point photograph.

- Limitations
- Record-group and catalog-level mapping only - no box-level retrieval performed; the existence of asbestos-specific documents in these series is unverified. The Pruitt exhibits are the most promising lead because they were already litigated to the summary-judgment stage.

- Finding
- Source discrepancies logged: (a) design type - MARAD status card, MARAD sales record, shipscribe class table, and Auke Visser compilation read T3-S2-A1 (Auke Visser table also shows T3-S2-A1 in row data); NavSource and derivative compilations read T3-S2-A3; NHHC DANFS prints 'T3-S2-1' [sic] - official MARAD card carried. (b) Laid-down date - DANFS/shipscribe 1944-06-05 vs NavSource 1944-06-06. (c) Complement - DANFS 313 vs NavSource 20 officers + 310 enlisted (330) vs shipscribe class figure 263 (1944). (d) Vietnam service stars - DANFS 12 vs NavSource ribbon display 13. (e) 1947-1951 flag status - shipscribe 'To NTS 1 Mar 47 / MSTS Commissioned Naval Vessel 1 Oct 49 / ComServPac 1 Aug 51' vs NavSource 'decommissioned December 1949, USNS to February 1951, recommissioned 24 May 1951' vs DANFS 'ceased to be a commissioned ship' at MSTS formation. (f) Wikipedia infobox 'Decommissioned July 1973' contradicts DANFS 1975-04-15 - Wikipedia not cited.
