The record
In 1971 Dr. Seymour Lewin and Dr. Arthur Langer reported testing talc samples including J&J powder and finding possible asbestos; J&J sent Lewin's samples for re-testing by the Colorado School of Mines Research Institute and Walter C. McCrone Associates.
Claim scope
The earliest date at which a published opinion places an outside report of possible asbestos in J&J's own powder specifically: 1971, one year earlier than Ingham's 1972 Lewin date.
What this source does not establish
The opinion says “possible asbestos”, not asbestos. And the re-testing it describes was J&J commissioning independent verification, which is also the defence's account. Do not present the 1971 date as an established positive finding in JBP.
Limitations
Note the date tension across published opinions on when Lewin first reported on J&J product: Lanzo says 1971, Ingham says 1972. Both are published. State the discrepancy.
