Claim scope
That the asbestos-in-talc question has been contested in published federal appellate litigation since at least 1984, and that a federal court of appeals once vacated an agency finding of asbestos in a talc product. Documents that Hull Pottery Company used Ceramitalc HDT in ceramic manufacture and that OSHA inspected July 20-21, 1977.
What this source does not establish
It does NOT establish that the talc was asbestos-free. Vacatur turned substantially on jurisdictional and procedural grounds — the Commission itself argued 'this Court has no subject matter jurisdiction over this action, both because there is no case or controversy.' This case must be cited in the interest of representing the dispute honestly; it is a defense-favorable published outcome.
