A Johnson & Johnson internal marketing document headed "- JOHNSON'S BABY POWDER -" and hand-dated 8/5/92 is reproduced in full in the printed record of the House Oversight Subcommittee on Economic and Consumer Policy hearing of March 12, 2019, at pp. 30-31, bearing Bates numbers JNJ 000021093-94 and the stamp "Protected Document--Subject to Protective Order."
Claim scope
The hearing print REPRODUCES the memo document itself as a facsimile image in the appendix, not merely a description of it. The page can therefore quote the memo's own words and cite the hearing print as the source of the reproduction.
What this source does not establish
The hearing print does not authenticate the document, identify its author or recipients, establish that the plan described was executed, or make any finding about the company's reasons for the plan. A memo reproduced in a hearing appendix is a document submitted by a member of Congress, not a fact found by any tribunal.
Limitations
IMPORTANT NUANCE: the memo bears NO typed title reading 'Johnson's Baby Powder: Major Opportunity.' Rep. Pressley described it that way in her oral statement; the document's own typed header is '- JOHNSON'S BABY POWDER -' and its section heading is 'Major Opportunities' (plural). Do not put 'Johnson's Baby Powder: Major Opportunity' in quotation marks as the memo's title. Attribute that phrasing to Rep. Pressley's characterization, or describe the document neutrally. TRANSCRIPTION PROVENANCE: this quote is a composite of the memo's typed header, handwritten date, and section/item headings, assembled from separate lines of the facsimile. The item-2 heading was transcribed from a 6x-9x visual render: the govinfo OCR layer renders it as 'Investigate ethnic (African American Hispanic) onportunities to grow the ~' — dropping the comma, misreading 'opportunities', and losing 'franchise.' The visual render is unambiguous. Do not quote the OCR text layer of this PDF.
