The record
Talc-based cosmetic products remained on sale outside the United States and Canada after the 2020 North American discontinuation, and litigation over non-US talc sales was active in Australia and Scotland as of 2026.
Claim scope
From a primary SEC filing: a roughly three-year window (2020-2023) in which the product was withdrawn in North America but still sold elsewhere. The FY2024 10-K confirms the split responsibility: J&J retained talc liabilities for US and Canadian sales while Kenvue 'remain[s] responsible for all liabilities ... resulting from ... the presence of or exposure to talc or talc-containing products sold outside the United States or Canada.' The Q1 2026 10-Q records ongoing non-US proceedings: 'in February 2026, an Australian law firm announced it has commenced a proceeding in the Supreme Court of Australia against J&J and the Company's affiliates', and 'In March 2026, claimants applied for a group action against Kenvue UK Limited, J&J, and J&J's subsidiary ... in the Court of Session in Scotland.'
What this source does not establish
Does NOT establish that any specific country continued to receive the product, or for how long — the filing says only 'certain other markets around the world'. Does NOT establish contamination of the non-US product. The Australian and Scottish matters are ALLEGATIONS in early-stage proceedings: the 10-Q states the Australian 'proceedings have not been served' and that Kenvue 'is unable to reasonably estimate either the likelihood or the magnitude of its potential liability.' Pending foreign trial-level actions are NOT citable as findings and are NOT published appellate opinions.
Limitations
Cite for the SALES CHRONOLOGY and the liability split only. Do not cite the Australian or Scottish matters as evidence of harm or contamination — they are unadjudicated claims recorded in a corporate filing. Under house standards, unpublished/trial-level foreign proceedings are not citable for factual propositions.
